10/12/11 Animal Cruelty Charges Disputed (more)



A Cashmere area man accused in a case of alleged animal cruelty has been ordered to appear in Chelan County District Court on October 31st.

 

Bob Stewart was in court Monday for a probable cause hearing but the 69 year old Mission Creek Road resident argued he's immune from prosecution. Stewart, who has filed a federal lawsuit in the matter, contends prosecutors have no legal jurisdiction over his property.

 

Stewart has been charged with unsafe animal confinement and failure to provide veterinary aid to horses he had on his property. The horses were confiscated last month by animal control officers and Deputies with the Chelan County Sheriff's department. Officials with the Wenatchee Valley Humane Society reported that the horses were malnourished and that one was such bad condition that it had to be euthanized.

 

 

However, during Monday's court proceedings, District Court judge Alisha Nakata ruled there was adequate probable cause to move forward to trial.
