01/09/12 Supreme Court Hears PFD Case



The State Supreme Court Tuesday is set to hear oral arguments on paying debt on the Town Toyota Center. The Greater Wenatchee Regional Events Center Public Facilities District is appealing a lower court ruling that determined the City could not enter into an agreement with the PFD to help pay down the arena's 42 million dollar short-term interest only loan. Chelan County Superior Court Judge John Bridges ruled that would exceed the City's legal debt capacity. The short term loan went into default last month. However it's not clear how the court's decision, upholding or overturning Judge Bridges September ruling, will impact efforts to pursue a sales tax increase to help pay off the debt. PFD attorney Pete Fraley says he will argue that under state law, loaning money to another entity does not constitute debt. The State Supreme Court will hear the case at 1-30 Tuesday afternoon.  It's not known how long it will take the court to issue a ruling. Fraley says he's asked the court to expedite the process if possible. That could be up to several weeks. TVW will broadcast the hearing on-line at "www.tvw.org"
